She has RIGHT not to take the polygraph test

I believe most cops are good cops. However, when an innocent person was alleged and become a suspect in their investigation, it will be another story. When you become their suspect, the cops will not trust you. No matter what you tell them, they won't believe you. All statements you gave them only good for them to find something to frame you.
 
From our encountering, my wife was very cooperative and gave statement to the best of her knowledge. She was asked to do the polygraph test, in which she agreed to take at first as she knew she would pass the test. However, after seeking legal advice, her lawyer advised her not to take test as the polygraph cannot be used in court and it won't help her case even she passed the test. In additional to that, if she is too nervous, there is a possibility that she will fail the test even if she is innocent.  She has RIGHT not to take the test.
 
When she turned down the polygraph, the cop was angry and accused her not cooperating with police. The cop refused to talk to any witness who could provide useful information. He said unless she takes the polygraph, he will stop investigation and put her as suspect in the case for 5 years. She thought she has her right, now "she is a suspect" will show up in her police background check in the next 5 years. Yes, she will have trouble doing any volunteer work in our son's activity.
 
We just don't know how to fight. Or I should say we can't afford a lawyer to fight for her. Life is beautiful, but sometimes it could be just unfair.
